Β Β  Just the basics . My new Trike build is totaled. Lucky wife was not on it at the time.

Pick up truck in KY ,left turn in front of me. Helmets save your life. I few over the truck head first on the road.

Β Met a few fine Marshall County Sheriff officers and was given a ride in an ambulance to Baptist Hospital . Spent better part of the day there.

Broken thumb banged a bit Sore all over . But ok I guess. Rented a car to drive home.

Kentucky is a no fault state. So pretty much he gets off with nothing.

Good to see you telling the story.

Stuff is just that even when you work hard for it.

The no fault part is unusual.Β

Dog Gone It...smitty901, just when I got to be envious of your new trike, and its' great fuel mileage, some wanker in No-Fault Kentucky has to do a left turn in front of you.

As said by others above, thankfully your wife was not with you, and you took on the role of superman, and flew through the air with the greatest of ease, except...that danged thumb. Thankfully, you have a spare thumb...

Really glad you are going to be okay.Β  Such a beautiful rig.Β  Keeping paws crossed that things go well with the insurance side.

Hopefully the driver of the truck was sited by the police.Β  It would be a crime if he wasn't.

Even if he isn't cited your insurance co will likely go after his/him for settlement.Β  Doesn't do much for you, but maybe there is some tiny amount of justice to be had.Β  sigh.

Retired insurance agent here.

That's not what "no-fault" means.Β  Primarily, no-fault applies to collision damage.Β  Instead of suing the at-fault driver, in Kentucky each driver settles his own collision claim with his own insurance company.Β  You can't collect from the other guy. If you don't have collision coverage, you are SOL.Β  You shoulda bought collision coverage, because you can't sue the other guy.

BUT . . . when it comes to injuries caused by the other guy, it's a whole new ball game.Β  Unless your medical expenses are less than $1000, then you sue the other guy just like in any other state.Β  In fact, even if you medical bill is under $1000, if you break a bone (any bone, including your thumb!), you can totally sue outside of the no-fault system.

If I was you I'd definitely hire an attorney.Β  The kind of lawyer who advertises on TV.Β  A lawyer from Kentucky, not from your home state. Here's a guy from Louisville who calls himself "The Hammer".Β  Just the kind of lawyer I'm talking about. [LINK]Β Plus, the suggestions on that page of his website are pretty good.

There are no hard and fast rules as to how much your injuries are worth, but I'd guess a broken thumb and a bunch of soft tissue injuries would be worth at least $30,000.Β  $10,000 would go to the lawyer, $10,000 to your medical insurance carrier, and $10,000 to you. All paid for by the other guy's insurance.

Given WHO builtΒ  that brand new trike, (Hannigan) and thatΒ  Hannigan isΒ  in Kentucky,Β  IΒ  wouldΒ  at leastΒ  ask Dave & Ruth Anne HanniganΒ  if theyΒ  can recommend aΒ  viciousΒ  attorney.Β 

But...YES.....forΒ  any personalΒ  injury....sue theΒ  no goodΒ  left turningΒ  wanker.

Β First I pray for calm .Anger at the person will serve no one. I had a talk with one of the witnesses . And what he said made a lot of sense.

The man told LE he was looking for were to turn into a drive way. He got confused and tuned to early.Β  When he saw me he hit the gas straight into the ditch.

Had he not floor it. I would have contacted the engine compartment or passenger door area. Lucky for me I contacted the softer box area.

Any settlement may take some time and lawyers .

Today I purchased a 2020 RGL from Chicago HD. of course I can refuse it if it is not what I expect. Be a week or so before I go get it.

I am thinking about going down this week and getting my Trike out of lock up and bring it home.

Life is strange. It crash had not happen We would have missed church today. Pastor was waiting for me when we were leaving had important question ask me. Guess I was suppose to be in church toady.

Β KY is a No fault state. His insurance pays him not me. I have plenty of insurance. I do not live in a no fault state. But forced to follow KY laws.

Really sorry to hear about the crash, but glad you made it through with limited personal damage!Β  Real bummer to loose such a nice rig, so soon.

Β When this is over regardless of the No fault crap. No madder what BS my insurance pulls. I will have my Trike back on the road. I will finish the plan to have Payton's sidecar on a RG and back ready for her to ride.
