Fines for Young Passengers

12

Well Folks - I have taken a vote of the Board of Directors and of the members of the Board - 7 have voted no - we don't want nor can we afford a legal team. It was recommended that we launch a letter writing campaign to the appropriate officials in the states where there might be a concern. It behooves the regional and state reps to make themselves aware of the state statutes concerning motorcycle with sidecars in their respective states. (This is a suggestion - not an order.)

Has anyone looked in the "Legislative Watch" section?, I skimmed through it and didn't see anything but should something be found maybe it could be posted there for reference in the future.

Good plan Chuck!!

The only state that I can recall requiring seat belts in sidecars was West Virginia, although there are most likely others.

What I have done is gone to my state's website and searched for any laws/requirements for sidecars in the motorcycle section.

At one time Hal Kendall one of the founders of the USCA had a compiled listing of state laws, he had helped me with the "3rd axle" issue here on the New York Thruway many years back.

I live in WV and I researched all our local and state laws. WV actually requires a seatbelt , since we were traveling alot in our rig I use a carseat and I made a "Redneck Hans Device". VA, PA and MD have nothing that I can find in their laws about sidecars.

Doug, The best I recall WV has had that law for close to 20 years that I recall

If there is one thing you can trust on, is:
There is always one law that will contradict the other one.
At least in Costa Rica.
Technical revision and transit law say, you do not need a seat belt in your sidecar. (specially if it does not come from the factory)
BUT the DMV equivalent, Cosevi, the institution that take the driver licence tests, will not permit you to make a drivers test without a seat belt installed.

You all know, that US judges and even more the lawyers, think they are above international borders, above legal laws, above moral rules and do not have to obey common sense at all.
So, why do you wonder?

Sorry, I could not keep back this last one. chuckle.
Sven 😉
